These booking terms ("Booking Terms") are between the self-catering unit (referred to as "we"/"us"/"our"/"the Accommodation") named under the "Reservation Confirmed with" section of the booking confirmation ("Booking Confirmation") and the person or legal entity making the booking ("you"/"your"). These terms are for the provision of accommodation services ("Booking(s)") by us to you. These Booking Terms are governed by English law and apply to all bookings. By making a booking you are deemed to accept and be bound by these Booking Terms.
The payment method ("Payment Method") is the credit card, debit card or bank account used by you to make payment to us. We are not responsible for any loss suffered by you as a result of incorrect payment-method information provided by you. When you make a payment using a credit card, we (or our parent company or our trading name if different) will be displayed as the merchant of record.
Bookings:
Bookings are made and a contract between you and us comes into effect when we accept a reservation from you. We will accept a reservation when we have confirmed your reservation and received either (i) full payment of the total price; or (ii) any other amount we have specified at the time of your booking.
The listing price ("Listing Price") is the price displayed on our website for the Accommodation for the number of guests staying at the property for the duration of the reservation at the date and time when the booking was made as shown in the Booking Confirmation.
When you book, you are agreeing to pay all charges for your booking including the listing price, applicable fees, taxes and any other items identified during booking checkout (collectively, “Total Price”). You are also agreeing that we may charge the payment method used to book the Listing in order to collect Damage Claim (as defined in these Terms) amounts. In addition to these Terms, you will be subject to, and responsible for complying with, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies, and requirements prior to booking.
Accommodation Reservations:
An Accommodation Reservation is a limited licence to enter, occupy and use the accommodation. We retains the right to re-enter the accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with us, and (iii) consistent with applicable law. If you stay past checkout, we have the right to make you leave in a manner consistent with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed guests. If the number of guests staying at the accommodation exceeds the number of guests booked to stay at the accommodation, we have the right to charge your payment method with the additional charges applicable for the additional guests for the entire duration of your reservation.
Reservations for Experiences and Other Services provided by us:
An Experience or other Service Reservation entitles you to participate in, attend, or use that Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness or other requirements. You are responsible for informing us of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend or use the Service. Except where expressly authorised, you may not allow any person to join a Service unless they are included as an additional guest during the booking process.
Cancellations, Travel Issues, and Refunds:
In general, if you cancel a reservation, the amount refunded to you is determined by the cancellation policy that applies to that reservation. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control requires you to cancel a reservation, you may be entitled to a partial or full refund under our Extenuating Circumstances Policy (see below). If we cancel your Reservation, you will be entitled to a full refund unless the reason for cancellation is outside our control and is an Event specified in our Extenuating Circumstances Policy.
Booking Modifications.
If you request a booking modification, you agree to pay any additional amounts, fees or taxes associated with that Booking Modification.
Your Responsibilities.
You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation or Experience. For example, this means: (i) you are responsible for leaving the Accommodation (and related personal property) in the condition it was in when you arrived, (ii) you are responsible for paying all Damage Claim amounts necessary to cover damage that you, your guest(s), or your pet(s) cause to an Accommodation, and (iii) you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorised to act on behalf of the minor and you are solely responsible for the supervision of that minor.
Extenuating Circumstances Policy:
Overview
This Extenuating Circumstances Policy explains how cancellations are handled when unforeseen events beyond your control arise after booking and make it impracticable or illegal to complete your reservation. This Policy applies to reservations for both accommodation and Experiences.
When this Policy allows for cancellation, it controls and takes precedence over the reservation’s cancellation policy. Guests that are affected by an event covered by this Policy can cancel their reservation and receive, depending on the circumstances and at our sole discretion, a full or partial refund. If we are obliged to cancel your reservation as a consequence of an event covered by this Policy, we may cancel without adverse consequences.
What events are covered
This Policy uses the term “Event” to refer to the following situations that occur after booking, are unforeseen at the time of booking, and prevent or legally prohibit completion of the reservation.
Changes to government travel requirements. Unexpected changes to visa or passport requirements imposed by a governmental agency that prevent travel to the destination. This doesn’t include lost or expired travel documents or other personal circumstances relating to a guest’s authorisation to travel.
Declared emergencies and epidemics. Government-declared local or national emergencies, epidemics, pandemics, and public health emergencies. This does not include diseases that are endemic or commonly associated with an area – for example, malaria in Thailand or dengue fever in Hawaii.
Government travel restrictions. Travel restrictions imposed by a governmental agency that prevent or prohibit travelling to, staying at, or returning from the Listing location. This does not include non-binding travel advisories and similar government guidance.
Military actions and other hostilities. Acts of war, hostilities, invasions, civil war, terrorism, explosions, bombings, rebellions, riots, insurrection, civil disorder, and civil unrest.
Natural disasters. Natural disasters, acts of God, large-scale outages of essential utilities, volcanic eruptions, tsunamis, and other severe and abnormal weather events. This does not include weather or natural conditions that are common enough to be foreseeable in that location – for example, hurricanes occurring during hurricane season in Florida.
What is not covered
Everything else. This Policy only allows for cancellations for the Events described above. Everything else is excluded. Examples of situations that this Policy does not allow cancellations for include: unexpected disease, illness, or injury; government obligations like jury duty, court appearances or military duties; travel advisories or other government guidance (that fall short of a travel ban or prohibition); cancellation or rescheduling of an event for which the reservation was made; and transport disruptions unrelated to a covered Event like road closures, as well as flight, train, bus and ferry cancellations. If you cancel a reservation in these cases, the amount refunded will be determined by the cancellation policy that applies to the reservation.
